Navigating the Canadian Political System and Legislative Review
Track: International | Presenters: Mark Sward, Sterling Talent Solutions; Rhonda Fairweather, First Advantage | Canada is a different country with a very different constitution and political structure. Doing business in Canada is one of the first steps outside of the United States for an American screening company, and Canadian customers may need to work with U.S. screeners for their cross-border hiring needs. NAPBS Canada Granted Exemption for Background Screening Firms Under Bill 113
The Ontario government has confirmed the exemption to Section 12 of Bill 113 The Police Records Checks Reform Act, 2015, has been granted. This exemption covers third party agents, like our NAPBS members, and eliminates the need for sharing of the criminal record result with the applicant and obtaining consent from the applicant before sharing the information with a designated end user.

NAPBS Canada Chapter Seeks Exemption for Background Screening Firms Under Bill 113
On December 1, 2015, the Ontario government passed Bill 113, the Police Record Checks Reform Act, 2015 (the "Act"), which limits the types of information that can be released by police record checks and aims to standardize disclosure procedures as it relates to search results. The Canada Chapter has been lobbying the Ministry of Community Safety and Correctional Services ("Ministry") since April of 2015 to advocate for our profession. We are pleased to announce that as of Friday, October 5, 2018, the Ministry is actively drafting exemption language for both the criminal record check search and the criminal record check and judicial matters check.

Guidelines for Obtaining Meaningful Consent
The Guidelines for Obtaining Meaningful Consent are issued in concert with the Information and Privacy Commissioners in Alberta and British Columbia, who have legislation deemed substantially similar to PIPEDA and will be effective January 1, 2019. This delayed implementation is to ensure organizations have time to amend their practices, as necessary. The guidelines cover the principles for obtaining meaningful consent, which is a key requirement of privacy legislation in Canada and also includes a checklist of Must Do (legal obligations) and Should Do practices (best practices). Canada Criminal Record Checks Fact Sheet
Canadian Criminal Real Time Identification Services | Individuals may be required to obtain a criminal record check for employment, volunteer work or other civil screening processes. In order to complete these checks, a search may be conducted against various police databases, including the Royal Canadian Mounted Police (RCMP) National Repository of Criminal Records. At present, searches of the National Repository of Criminal Records may be done either by name and date of birth, or fingerprints.
